Waiver / liability release

I {name},     request the privilege of admission to Bozeman Aikido LLC (dba Big Sky Aikido), hereinafter called the Association.  I understand that Aikido is a martial art involving strenuous exercise and physical contact.  I further understand that neither the Association nor the organizers of this Association offer any assurance of guarantees of any sort, nor subscribe to any insurance against injuries to the participants or damage to their property.

In accordance with the law, this dojo does not exclude individuals with medical conditions that do not pose a medically recognized threat to the health or safety of the other students in the normal course of training. I understand that there are some unavoidable circumstances where these conditions may require special caution on my part to minimize danger to others, or myself and I acknowledge that it is my responsibility to act accordingly.

I understand that I may be training with someone who may be infected with diseases that can be transmitted by exchanges of blood, other bodily fluids. These diseases include but are not limited to HIV/AIDS and hepatitis. I acknowledged that I have read and will follow the dojo's procedures for dealing with injuries to myself and others that present opportunities for exposure to blood or body fluids.

I also understand that I may be exposed to individuals in the dojo that may have an infectious disease that may be spread by air borne transmission, respiratory droplets or person-to-person contact.   These infectious diseases include but are not limited to the common cold, norovirus, flu virus and other respiratory diseases such as Covid 19 (SARS-CoV-2).

I have read the dojo’s policy on hand washing and other protocols for avoiding the transmission of infectious diseases including not working out if I have a fever greater than 100.4 degrees or other symptoms including chills, sweats, difficulty breathing, new or worsening cough, whole body aches, vomiting or diarrhea (see attached Hygiene Protocol form).

As a condition to participating in martial arts classes and seminars at Bozeman Aikido, I assume the risk of all injuries including the transmission of infectious diseases and hereby hold Bozeman Aikido, their instructors, agents, officers, as well as the owner of the premises, and the Aikido Schools of Ueshiba, Inc. (ASU) harmless from any and all liability (including attorney’s fees and costs) for (1) all claims, actions or damages due to injuries including infectious diseases suffered by me or caused by third parties to me arising out of activities involving Aikido, any other martial arts or physical activities occurring on the premises of Bozeman Aikido; here and/or (2) loss or damage to personal property brought into or left on the premises.

In consideration of the privilege of being admitted to participate in the Association, of receiving the provided instruction and of using the Association’s installations for the classes, I hereby declare that I will personally assume all responsibility concerning any injury, including death, that I may incur or that may be inflicted on me by others during the classes, be it on or off the premises, before, after, during or between class sessions.  I hereby hold immune and release the Association, its directors, employees, agents and representatives, the organizers of the Association and the instructors of the Association from all responsibility, accountability and any reparations concerning personal injuries, death, lawsuits, damages, or losses of any nature whatsoever, in law or in equity, relative to the activities mentioned above.

In exchange for the instruction received, I hereby agree and engage, in my name and in the name of my heirs and beneficiaries, never to pursue, legally, or in equity, the Association, its directors, employees, agents or representatives, nor the organizers of the Association in relation to such injuries, lawsuits, damages, responsibilities, accountabilities, reparations or losses.

TO ATTEST TO THIS, I have signed this document and declare that I have read it and understand it.

UNDERSTANDING THE RISKS OF CONCUSSION AND TRAUMATIC BRAIN INJURY

A concussion is a brain injury that:

  • Is caused by a bump, blow, or jolt to the head or body.
  • Can change the way a person's brain normally works.
  • Can happen even if a student has not lost consciousness.
  • Can be serious even if a student has just been “dinged” or “had their bell rung.”

All concussions are serious. A concussion can affect a person's ability to do work and other activities (such as working on a computer, studying, driving, or exercising). Most people that suffer from a concussion do get better, but it is important to give the concussed student’s brain time to heal.

What are the symptoms of a concussion?

Concussions cannot be seen; however, in a potentially concussed person, one or more of the symptoms listed below may become apparent and/or that the person “doesn’t feel right” soon after, a few days after, or even weeks after the injury.

  • Headache or “pressure” in headNausea or vomiting
  • Balance problems or dizziness Double or blurry vision
  • Feeling sluggish, hazy, foggy, or groggy
  • Difficulty paying attention
  • Memory problems
  • Confusion Bothered by light or noise
In The Event of a Concussion:
If you believe you or someone else may have a concussion, tell an instructor immidiately.

The person should be evaluated by a licensed physician of medicine or osteopathic medicine (MD or DO) to be cleared to continue to train.

Concussed individuals should give themselves time to get better because the brain needs time to heal. While a concussed person's brain is still healing, that person is much more likely to have another concussion. Repeat concussions can increase the time it takes for an already concussed person to recover and may cause more damage to that person's brain. Such damage can have long term consequences. It is important that a concussed indivitual rest and not return to training until the indivitual receives permission from an MD or D, sufficiently familiar with current concussion management.

How to prevent a concussion?

  • Train within your limits and under the instructor supervision.
  • Weapons contact should happen with Shinai only
  • If you are uncomfortable in a situation, be up front and honest with your partner and instructor.

I {name}, hereby acknowledge that I am familiar with the nature and risk of concussion and traumatic brain injury while participating in Aikido including the risks associated with continuing to train after a concussion or traumatic brain injury.

Bozeman Aikido Vaccination Policy:

Proof of vaccination is required for indoor training.

Policy Goal

Our goal is to reduce the risk of serious illness or death from COVID-19. It will be up to individual members to decide if they wish to consent to the restrictions and remaining risks and participate in indoor classes. We are attempting to mitigate this risk by requiring all participants of indoor classes to provide proof of vaccination.

Guidelines

The following guidelines have been adopted for compliance with CDC guidelines and our dojo communities personal safety concerns.

  1. Indoor classes will be limited to FULLY VACCINATED persons only. This means 14 days after your final dose of the vaccine. This will go into effect on June 1st.
  2. All Dojo Members must provide documentation of their vaccination status. Please present proof of your signed vaccine card or equivalent. Everyone needs to follow this rule, there will be no exceptions. Showing your vaccine card to Cheryl, Leif or Christopher will be sufficient. DO NOT send a copy anby email.
  3. We will not require masks to be worn. The use of masks indoors is optional. Per the CDC’s previous announcement masks are not required indoors for fully vaccinated individuals in small groups.

 https://www.cdc.gov/coronavirus/2019-ncov/vaccines/fully-vaccinated.html

  1. Indoor classes WILL be normal, hand-to-hand practice, with ukemi. (Take it slowly, it has been quite some time since we were training at the level we were over a year ago.)
  2. While training indoors, we will operate the ducted air conditioning system which has been upgraded with a state-of-the-art UV air purification unit. There will also be an air purifier in the vicinity of the entry. This focus on good ventilation is a safety measure as well as an investment in our community’s health.
  3. Before every class, all participants will be required to sign in either on their personal cell phone or the provided computer. This will help us with contact tracing should the need arise.
  4. The small restrooms are the only available dressing rooms and will be open for those that want to use them.  Otherwise, please come dressed in your keiko gi.

FAQs

  1. Why is vaccination required to enter the dojo? It should be my choice whether or not to get vaccinated.
    • It is your choice whether or not you get vaccinated.  With COVID-19, the issue all along has been non-symptomatic infection and transmission. You may feel perfectly healthy but still be infected, and unknowingly pass that infection along to others. This can kill or permanently disable the vulnerable and you would never know about it. The dojo does not require vaccination for your protection. It requires vaccination for the protection of those around you. You may choose to remain unvaccinated, in which case, you will not be allowed to attend indoor classes.
    • To clarify this concept, consider the following analogies:
      • In a free society, adults should be able to choose to drink as much alcohol as they like, thus putting themselves at risk. However, they should NOT be allowed to then drive a motor vehicle on the open road, thus putting others at risk.
      • Adults should be able to choose to smoke cigarettes, but they should not be allowed to smoke cigarettes inside a public school.
  2. Why is proof of vaccination required? Can’t you just trust me?
    • The issue is not whether or not we trust you, but whether or not we can trust EVERY SINGLE PERSON who walks through our door. This includes visitors or new members we have never met. Although it is possible to forge vaccination credentials, the barrier to do this is much higher than having someone casually lie to us.  If you have lost your vaccination card we can accept other methods of verification. The goal is to provide a high level of safety and some peace of mind for everyone on the mat.
  3. When will these restrictions be released?
    • These policies are based on the evolving scientific understanding of Covid-19 transmission mechanisms. We have also taken into consideration community transmission phenomenon and information about transmission between vaccinated individuals. As thingsthe situation evolves and changes over time, we will poll dojo members again in order to come to a new consensus on acceptable risk for our community.
  4. Why do I need to log in before class?
    • The dojo must take available precautions in the event that we might have a viral outbreak. It is important that we operate as a responsible business. This also verifies your attendance for ASU belt examination requirements. We appreciate everyone’s help on this matter.
